Guarantee of Satisfaction – PaceButler Gold guarantees your satisfaction with our service by allowing you first to see what price we are offering for your items. PaceButler Gold is proud of the amounts we can offer. Where other companies refuse to advise you what they are paying for your items, some even after they have sent a check, we clearly post our pricing. In some instances, our prices are 2-3 times higher than our competitors. Our process is simple, fast, and rewarding. We want you to return as a customer and refer your friends and family to us. We know the best way to make this happen is to do everything within reason to ensure you are satisfied with our service. We look forward to doing business with you!
With regard to the Terms and Conditions of our program and website, "we" and "our" represent PaceButler Gold and "you" and "yours" represents you as our vendor, customer, or site visitor. When referencing “this site,” under the Terms and Conditions of our program, does represent www.PaceButlerGold.com.
Requirements – By use of www.PaceButlerGold.com, you agree to the terms and conditions of this site: You affirm that (1.) you are at least 21 years of age; (2.) the legal owner of the materials you wish to sell; (3.) you are the primary contact and not working on behalf of another, 3rd party representative, or a brokering agent. We reserve the right to refuse any shipment that does not meet these requirements or request further documentation to confirm that your transaction will meet the requirements outlined under our terms and conditions.
Shipping – PaceButler Gold will pay for all shipping charges for you to ship your items to us. In order to take advantage of the free shipping you must use the FedEx Prepaid shipping labels that we supply to you. To request a free label click here or you can call 800.248.5360. If you elect to ship your item by another method, you will be responsible for the shipping charges incurred. PaceButler Gold will not reimburse for those shipping charges. To ship free of charge simply use the Prepaid FedEx Shipping label we provide in your free Gold Kit.
To request a free Gold Kit, please complete and submit the on-line form located at www.PaceButlerGold.com. Your Gold Kit will be mailed within 24 hours to the address you entered on the on-line form.
We are proud to offer pre-paid FedEx shipping labels. Your gold and jewelry shipped via FedEx will be insured for up to $250. If you believe that you need additional insurance, then it is your responsibility to obtain such additional insurance at your expense before sending us your gold and jewelry.
Once you receive your Gold Kit, simply place your unwanted gold and jewelry into a zip lock bag and pack in any box, attach the FedEx label to the box, and ship your gold and jewelry to us from any FedEx location.
Please note that we only provide customers with pre-paid FedEx shipping labels. If you choose another shipping method, you will be responsible for the shipment, insurance, etc. We reserve the right to refuse and reject any delivery that in our opinion appears to have been tampered with, damaged, or opened.
Appraisal/Quote/Settlement/Payment – Once PaceButler Gold receives your items, we will sort, audit and appraise them for their value. The prices we pay are based on market value, and are subject to change. Once we have tested and appraised your item’s purity and weight, your payment will be issued via check and mailed within 4 business days.
Return Insurance Liability:
Inbound Shipments
Customers offering items for sale to PaceButlerGold understand and expressly agree that they will be offered the fair market wholesale value as established by PaceButlerGold for such items. If an item is returned to a Customer, PaceButlerGold will insure the item for no more than twice the amount offered as the purchase amount by PaceButlerGold regardless of what it was insured for when mailed by the Customer to PaceButlerGold. Customer agrees to waive any losses not covered by the amount of insurance purchased accordingly by PaceButlerGold. PaceButlerGold shall, in its sole discretion, choose the return carrier, insurance provider and receipt verification method for each such transaction. In the event the items returned to the Customer are lost, the customer’s sole remedy is to seek reimbursement via the insurance carrier and such losses and claims are subject to the terms and conditions of the insurance carrier and the policy purchased by PaceButlerGold on the customer’s behalf.
Outbound Return Shipments
In the event that your Merchandise is returned to you in accordance with these Terms and Conditions, we will ship your Merchandise to you at your address as it appears in our records via the FedEx shipping method of our choosing at our expense, and will insure the Merchandise for the full value of the rejected Quote. If a package containing your Merchandise is lost in transit while being returned to you in accordance with these Terms and Conditions, we will file a claim with FedEx and pay you the full value of the rejected settlement.
Independent Contractors
Nothing is this Agreement shall be deemed to create an agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between you and us.
No Third Party Beneficiaries
This Agreement is between you and us. There are no third party beneficiaries to this Agreement.
Non-Waiver
Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
Severability
The parties agree that each provision of this Agreement is intended to be construed to be enforceable to the fullest extent possible. If any provision or part of a provision of this Agreement is held to be unlawful, void, or unenforceable, that provision or part of the provision shall be deemed severable from this Agreement and not affect the validity and enforceability of any remaining provisions.
